Terms of Service

These Terms of Service (“Terms”) govern your use of Just Pick One, operated by Lee Kellogg (“we,” “us,” or “our”). By creating an account or using Just Pick One, you agree to these Terms. If you do not agree, do not use the service.
1. Description of Service
Just Pick One is a web application for organizing NFL survivor pools. A survivor pool is a game in which participants pick one NFL team to win each week; a wrong pick (or missed deadline, depending on pool rules) results in a strike, and players who accumulate too many strikes are eliminated. The last player or players remaining win the pool.
Just Pick One is not a gambling platform. No money is wagered through Just Pick One. The fee charged for creating additional pools is a service fee to cover operating costs, not a stake in any game outcome.
Just Pick One does not hold, collect, or distribute prize money, entry fees, or stakes of any kind among players. If members of a pool choose to arrange stakes or prizes among themselves, they do so entirely outside of Just Pick One, at their own risk, and are solely responsible for those arrangements and their compliance with applicable law. We have no obligation or liability with respect to any such arrangement, including in the event of a service interruption, data loss, or disputed pool outcome.
2. Eligibility
You must be at least 18 years old to create an account or purchase a paid pool. If you are between 13 and 17, you may use Just Pick One only with the involvement and consent of a parent or legal guardian. Just Pick One is not available to anyone under 13.
By using Just Pick One you represent that you meet these age requirements and that the information you provide is accurate.
3. Account
You sign in to Just Pick One using a Google account. You are responsible for all activity that occurs under your account. Notify us immediately at support@justpick.one if you suspect unauthorized access.
You may not create accounts on behalf of others or use Just Pick One to impersonate any person or entity.
4. Payments
Each person may create one basic pool per season at no charge. Basic pools have fixed rules and a limited player count. Full-featured pools require a one-time fee of $10 USD per pool per season, charged at the time of pool creation or upgrade. During promotional periods (including the 2026 season), your first full-featured pool of the season may be discounted, including to $0. Prices and promotions are subject to change; we will update these Terms if they do.
All payments are processed by Stripe. By making a payment, you also agree to Stripe’s terms.
Refunds. Pool creation fees are non-refundable once a pool has been created and is accepting members. If you experience a technical failure during payment that results in a charge without a working pool, contact us within 7 days and we will issue a refund. Refund of the pool creation fee is your sole and exclusive remedy for any failure of the service.
5. Pool Rules and Commissioner Responsibilities
Each pool is controlled by a commissioner — the person who created it. Commissioners configure pool rules (number of strikes, auto-pick behavior, etc.) and may remove players. Commissioners are responsible for operating their pool fairly and in accordance with these Terms.
Just Pick One enforces rules technically where possible (e.g., preventing duplicate team picks, locking picks at the deadline), but we are not responsible for disputes between players that arise from commissioner decisions or rule interpretations. How a pool responds to a service disruption, data error, or disputed result is a matter for the commissioner and its members, not Just Pick One.
6. Acceptable Use
You agree not to:
- Use Just Pick One for any unlawful purpose
- Attempt to manipulate game outcomes through technical means (e.g., submitting picks after a deadline through unauthorized API access)
- Harass, threaten, or abuse other users
- Reverse engineer, scrape, or disrupt the service
- Create multiple accounts to circumvent limits or bans
We reserve the right to suspend or terminate accounts that violate these rules.
7. NFL Disclaimer
Just Pick One is not affiliated with, endorsed by, or sponsored by the National Football League (NFL) or any NFL team. All team names and logos are the property of their respective owners. Game scores and schedule data are sourced from third-party APIs and may occasionally contain errors; we are not liable for pick outcomes affected by data errors, though we will make reasonable efforts to correct them.
8. Intellectual Property
Just Pick One and its original content, features, and functionality are owned by Lee Kellogg. You may not copy, modify, distribute, or create derivative works from any part of Just Pick One without our written permission.
9. Service Availability, Changes, and Data
We may modify, suspend, or discontinue Just Pick One, in whole or in part, at any time, with or without notice — including during an active season — for maintenance, upgrades, technical problems, or any other reason. We do not guarantee that the service will be available at any particular time, including at pick deadlines or while games are being scored. Service interruptions may result in missed picks, delayed or incorrect results, or altered pool outcomes.
We do not guarantee that any data you submit — including picks, standings, and season history — will be preserved, backed up, or recoverable. Data may be lost, corrupted, or deleted, including through error, outage, or failure of the third-party infrastructure Just Pick One runs on. If records matter to you or your pool, keep your own copies.
We are not responsible for events beyond our reasonable control, including failures of third-party hosting, data, or payment providers, internet or power outages, labor actions affecting NFL games, or other force majeure events.
10. Disclaimer of Warranties
Just Pick One is provided “as is” and “as available” without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, timely, secure, or error-free, that results and standings will be accurate, or that data will never be lost. Use Just Pick One at your own risk.
11. Limitation of Liability
To the maximum extent permitted by law, Lee Kellogg shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, loss of use, or loss of goodwill, arising out of or relating to your use of (or inability to use) Just Pick One, under any legal theory (contract, tort, negligence, or otherwise), even if advised of the possibility of such damages.
Without limiting the foregoing, we shall have no liability of any kind for: (a) unavailability, interruption, suspension, or discontinuation of the service; (b) loss, corruption, or deletion of any data, including picks, standings, and season history; (c) missed picks, strikes, or eliminations caused by technical failures or deadline processing; or (d) incorrect game data, scoring, results, or pool outcomes.
Our total cumulative liability for all claims arising out of or relating to Just Pick One shall not exceed the amount you paid to us in the 12 months preceding the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
12. Indemnification
You agree to indemnify and hold harmless Lee Kellogg from any claims, damages, or expenses (including reasonable legal fees) arising from your violation of these Terms or your use of Just Pick One, including any stakes or prize arrangements made between pool members.
13. Changes to These Terms
We may update these Terms as the service evolves. We will update the “Last updated” date at the top of this page. For material changes, we will make a reasonable effort to notify you (e.g., via email or an in-app notice). Continued use of Just Pick One after changes constitutes acceptance of the updated Terms.
14. Termination
We may suspend or terminate your access to Just Pick One at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users or the service. You may terminate your account at any time by contacting us.
15. Governing Law and Disputes
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or Just Pick One shall be brought exclusively in the state or federal courts located in Massachusetts, and you consent to the jurisdiction of and venue in those courts. To the extent permitted by law, any claim must be filed within one year after it arose, and you may bring claims only in your individual capacity — not as a plaintiff or class member in any class or representative proceeding.
